Welcome to MyBabyFits. These Terms & Conditions (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). Please read them carefully. By visiting or purchasing from MyBabyFits, you agree to these Terms.
1. Acceptance of Terms
By accessing the Services, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases or create an account. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts & Security
- You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
- Please notify us immediately if you suspect unauthorized use of your account.
- We may refuse service, close accounts, or cancel orders at our discretion if we believe these Terms are violated.
4. Orders & Availability
- All orders are offers to purchase and are subject to acceptance by MyBabyFits.
- We may limit or cancel quantities purchased per person, per household, or per order, including suspected reseller purchases.
- Product images and colors may vary due to screen settings and manufacturing variations.
5. Pricing & Errors
We strive for accuracy, but pricing, availability, and descriptive errors may occur. We reserve the right to correct any errors and to cancel orders arising from such errors, even after an order is submitted.
6. Payments
- We accept the payment methods shown at checkout (e.g., card, PayPal, Shop Pay, etc.).
- By submitting payment information, you represent that you are authorized to use the payment method.
- Charges will be in the currency displayed at checkout unless stated otherwise.
7. Shipping & Delivery
- Shipping options, costs, and estimated delivery times are shown at checkout. Estimates are not guarantees.
- Risk of loss passes to you upon our delivery to the carrier. Title passes when the order is paid and shipped.
- International customers are responsible for duties, taxes, or import fees unless otherwise stated.
8. Returns & Refunds
Our Returns & Exchanges policy explains how to initiate a return, the return window, and the condition items must be in. Refunds are issued to the original payment method where possible. Some items (e.g., final sale, hygienic items) may be non-returnable—see the policy for details.
9. Gift Cards
- MyBabyFits gift cards are redeemable only for eligible products on our site and cannot be exchanged for cash (except as required by law).
- Lost or stolen gift cards will not be replaced. Treat gift cards like cash.
- Balance inquiries may be available via your account or a dedicated balance page.
10. Promotions, Coupons & Referral Programs
- Promotions are time-limited, may be subject to additional terms, and may be modified or discontinued at any time.
- Unless stated, promotions cannot be combined. Referral or rewards programs may have separate rules.
11. Reviews & User Content
- By submitting reviews, photos, or other content, you grant MyBabyFits a worldwide, royalty-free license to use, reproduce, and display that content in connection with the Services.
- You represent you own or have rights to the content and that it does not infringe the rights of others.
- We may remove content that we deem unlawful, misleading, spam, or otherwise inappropriate.
12. Prohibited Activities
- Resale without authorization, scraping, interfering with site security or performance, and any unlawful activity are prohibited.
- Do not use the Services to share harmful code or to impersonate others.
13. Intellectual Property
All content on the Services—including text, graphics, logos, product names, and images—is the property of MyBabyFits or its licensors and protected by law. You may not use our IP without prior written permission.
14. Third-Party Services
We may integrate with third-party platforms (e.g., Shopify, payment processors, Zendesk for support). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party sites or services.
15. Disclaimers
EXCEPT AS REQUIRED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYBABYFITS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS GIVING RISE TO THE CLAIM.
17. Indemnification
You agree to defend, indemnify, and hold harmless MyBabyFits and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or infringement of any third-party rights.
18. Governing Law
These Terms and your use of the Services are governed by the laws of the state or country where MyBabyFits is established, without regard to its conflict of laws principles.
19. Dispute Resolution
If a dispute arises, please contact us first. Where permitted by law, disputes may be resolved through binding arbitration on an individual basis, and not in a class or representative proceeding. If arbitration is not applicable in your jurisdiction, disputes shall be brought in the courts of the governing venue identified above.
20. Changes to Terms
We may update these Terms from time to time. The “Last updated” date will reflect the latest revision. Continued use of the Services after updates constitutes acceptance of the revised Terms.
21. Termination
We may suspend or terminate your access to the Services at any time for conduct that we believe violates these Terms, is harmful to other users or to us, or for any other lawful reason. Sections that by their nature should survive will survive termination.
